Case Filed for Injury Caused by Fluoridated Water

Nidel Law, P.L.L.C., in conjunction with Paulson and Nace, P.L.L.C., filed a case against Nestle U.S.A., Nestle Waters North America, Inc., and the Gerber Products Company, for damage caused by fluoride contained in their products marketed and sold for consumption by children under the age of eight. The Plaintiff, a 13-year old girl, suffers from “dental fluorosis” which is a permanent disfigurement of her teeth.
According to the CDC, dental fluorosis is caused by the ingestion of fluoride before the age of eight. While many in the public may have heard the claims that fluoride prevents cavities, according to the CDC the preventative benefits of fluoride are predominantly when it is applied topically (rather than ingested) to adult teeth, after the age of eight. The science thus shows that when fluoride is ingested by people under the age of eight, there is a significant risk of harm, while at the same time there is no benefit. The defendants in this case knew that their products contained fluoride and actively marketed these products to children and to parents for the use in their children. The defendants’ failure to warn of the risk of harm from these products is unacceptable.

It’s about time we stop ingesting chemicals that are meant to be applied topically.

Nestle has a hotline for infant formula. In many contacts to them starting about 2005 they always would mention but only if asked specificly to not use fluoridated water with formula. They said it was because of the ACP guidelines. After the Nov 9 2006 ADA Egram to dentists they still cited the ACP not the ADA or CDC. At one point of after asking them many times why they did not have a written notice on the product they said they were considering it.I also contacted all the other formula producers and notified them of Nestle and their warning and asked why they did not warn of this known risk. This was multiple times before and after the Nov 9 warning by ADA to dentists.
Got my own dentist Mayor to post it on city website and in newsletter and a year later on cable TV to the entire county. I got to review the notice written by the cable company before it aired. The city did not write it nor did I. It was with official city crest etc.
Fluorides are terrible, no doubt. However, unless the American people are really willing to sink their teeth (pun intended) into this issue, the problem is not going to be rectified. The U.S. government, big corporations, and the dental lobby are too big and too powerful – in fact, they are nearly invincible. Thus, if the big boys want us to swallow fluoride, then it’s going to take a near shaking of the earth for the people to win. As far as law suits are concerned, as most judges are bought and paid for flunkies for the government and corporations, I’m not optimistic for realizing legal victories. Hope I’m wrong!
