    On Thursday, December 30, 2021 residents of Curtis Bay, Maryland felt their homes shake as a loud boom echoed throughout their community. When residents looked outside, they saw a plume of black smoke rising from the coal terminal to the east of their neighborhood. CSX Transportation, Inc., has operated the coal terminal for the past 140 years.

    Following the blast, investigations of the facility determined that the explosion was caused by the ignition of a localized flammable atmosphere of methane released from the coal and airborne coal dust released from the conveyor, which increased the flammability of the methane. Low ventilation in the conveyor generated a pressure wave through the reclaim tunnel that increased through the tunnel and resulting in a plume of coal dust that blanketed the Curtis Bay neighborhood.

    CSX claims that no one has been hurt from the explosion, but there has not yet been a comprehensive assessment into the health implications for the community following the explosion. 

    On March 18, 2022, Nidel & Nace filed suit against CSX in the United States District Court for the District of Maryland. The lawsuit is brought on behalf of all residents living within the area of impact and the class is being represented by two Curtis Bay residents who were victims of CSX’s conduct.

    Coal dust includes several known toxins, including arsenic, silica, mercury, and other heavy metals. Inhalation of coal dust can cause significant health issues, including Coal Workers’ Pneumoconiosis, silicosis, mixed dust pneumoconiosis, dust-related diffuse fibrosis and chronic obstructive pulmonary disease.

    The mining, processing, and burning of coal poses a number of risks to the environment and to human health. Coal combustion releases Sulfur dioxide (SO2), Nitrogen oxides (NOx), particulates that contribute to smog, haze, respiratory illnesses and lung disease, carbon dioxide (CO2), mercury and other heavy metals, and fly and bottom ashes (residues created when power plants burn coal) that are laced with toxic heavy metals and radioactive particles. Improper storage of bottom ash residues has resulted in disastrous consequences for groundwater and surface waters in the United States. Yet, coal-burning power plants still comprise approximately 21.8% of U.S. electricity. 

    Nidel & Nace is committed to combatting these environmental challenges because a clean and safe environment is a human right. Industry in Curtis Bay has, for too long, taken advantage of its place in the community, neglecting the health and wellbeing of those residents it shares the air and soil with. This incident is a brazen example of reckless disregard for local residents.

    The town of Bethel in Eugene, Oregon has shared its air and groundwater with J.H. Baxter and Company for over 100 years.  During this period, the chemicals used in wood processing and treatment have taken their toll on the local environment.  There is an identified plume of groundwater that has been seeping out into the neighboring community of Bethel for decades, containing several toxic chemicals including pentachlorophenol (“PCP”) an industrial wood preservative.  The levels of PCP found in the groundwater are over 4,000 parts per billion, which is 10,000 times the safe drinking water standard for California. In addition to groundwater, the activities of this Facility have likely impacted soil and other environmental receptors in the area.  The chemicals used and released by this Facility have been linked with severe health and environmental effects including cancers and other diseases.

    According to the Oregon Department of Environmental Quality, the facility has been under regulatory orders due to environmental conditions since the mid-to-late 1980s.  However, it does not appear that, despite state attention to the impacts of the Facility, anything has been done to identify and remediate off-site soil contamination from its operations:

    The primary remaining RI tasks include completion of the ecological risk assessment, determination of the presence and/or extent of off-site arsenic and PAH contamination in soil, revision of the human health risk assessment, and identification of “hot spots” of contamination. 

    Thus, it is highly likely, though currently unknown, what the extent of off-site contamination is in the community.

    The town of Bethel has shared its air and groundwater with J.H. Baxter and Company for over 100-years.  During this period, the chemicals used in wood processing and treatment have taken their toll on the local environment and on residents quality of life. What is most disturbing, is that it has recently been exposed that, according to an investigation by the State DEQ, J.H. Geared up to gamble along with heart of vegas. Baxter has been using its processing equipment to evaporate its hazardous wastes and emit the toxic gases into the community starting in at least 2010 and happening as often as every month:

  • SSRI Use During Pregnancy May Damage Human Brain

    A group of researchers, including those from the John’s Hopkins Bloomberg School of Public Health, found that the molecule paroxetine (the active ingredient in the antidepressant Paxil and one of the class of SSRI antidepressants) is associated with developmental neurotoxicity. In their paper*, entitled “Antidepressant Paroxetine Exerts Developmental Neurotoxicity in an iPSC-Derived 3D Human Brain Model” published in Frontiers in Cellular Neuroscience, the authors found repeated indication that:

    relevant therapeutic concentrations of Paroxetine induce brain cell development abnormalities which could lead to adverse effects

    This conclusion was drawn from experimental work using stem cell models of the human brain.  This work was done in an effort represent human pathophysiology in a way that may not be captured by the animal models for neurodevelopment and for autism and other neurodevelopment impacts.

    This study, which avoids the use of animal models, provides additional evidence that Paxil and other SSRI and SNRI antidepressant medications may disrupt brain development in the womb and lead to lifelong injury.

    These are not the first studies to suggest that SSRI exposure during brain development can negatively impact brain function in ways that resemble ASD. In fact, there are several studies now that collectively indicate the risk to the human brain of taking these medications during pregnancy.

  • Deadly Refinery Pollution in Artesia, New Mexico

    The HollyFrontier refinery in Artesia, New Mexico has not been a good neighbor to those living in the immediate vicinity.  According to this analysis by the Environmental Integrity Project, fence line benzene levels far exceed the safe limits established by the Environmental Protection Agency.  In fact, reporting by E&E News demonstrates that this refinery has been emitting dangerous levels of benzene into the community for year all the while ignoring attempts to restrict those same emissions.  Regulators allowed HollyFrontier to continue operating despite its failure to repair leaks from aging and faulty equipment. 

    benzene is a known human carcinogen, which means it has been identified as causing cancer.  Benzene can cause a number of different types of cancer including leukemias and lymphomas.  In addition, benzene can have both chronic and acute health impacts beyond cancer.

    There is no justification for HollyFrontier’s inaction and their continued profit from the operation of this refinery in a manner that threatens the health of the surrounding public.

    As the White House extends social distancing guidelines amide the coronavirus pandemic until at least April 30th of this year, students in Virginia are returning to classes at Liberty University.  This despite the State of Virginia and Govern Ralph Northam’s order shutting down all non-essential businesses.  Jerry Falwell, Jr. welcomed students back from Spring break and seeks to continue housing students for their education. This reckless behavior poses a risk to the surrounding community in the town of Lynchburg in addition to the obvious risk to the students themselves.     Residents in the Villa Parks subdivision have reached out to our firm with concerns about the presence of toxic chemicals in and around their homes.  These concerns range from concerns about the health and wellbeing of family members to the impact that the newly discovered chemical contamination will have on property values and the ability of residents to sell their properties.

  • Nidel & Nace Pursues Class Action at Enclave Apartments

    Tenants at the Enclave Apartments in Silver Spring, Maryland have been living in unsafe and dangerous conditions due to the presence of mold, infestation and unhygienic conditions. They have now filed a Class Action Complaint against the current and former building managers and current owners of the property.

    The Enclave Apartments is a three-tower complex that has over 1100 units available for rent. In recent years, hundreds of complaints have been made to the Montgomery County Department of Housing and Community Affairs. In February, Bethesda Magazine reported:

    Inspectors from the county Department of Housing and Community Affairs inspected 829 units at The Enclave Silver Spring apartments, three high-rise buildings near the intersection of Routes 29 and New Hampshire Avenue, and found an average of 3.1 violations per unit late last month, county officials said.

    The lawsuit seeks to compel inspection and remediation of unhygienic conditions for each tenant, and seeks the repayment of rent for past months in which tenants lived in apartments that were uninhabitable due to poor conditions.     The town of Bethel has shared its air and groundwater with J.H. Baxter and Company for over 100-years. An individual should attempt a person’s lady luck heart of vegas.  During this period, the chemicals used in wood processing and treatment have taken their toll on the local environment.  There is an identified plume of groundwater that has been seeping out into the neighboring community of Bethel for decades, containing several toxic chemicals including pentachlorphenol (“PCP”).  The levels of PCP found in the groundwater are over 4,000 parts per billion, which is 10,000 times the safe drinking water standard for California. In addition to groundwater, the activities as this Facility have likely had impacts to soil and other environmental receptors in the area.  The chemicals used and released by this Facility have been linked with serious health and environmental impacts including cancers and other diseases.

    According to the Oregon Department of Environmental Quality, the facility has been under regulatory orders due to environmental conditions since the mid-to-late 1980s.  However, it does not appear that, despite state attention to the impacts from the Facility, anything has been done to identify and remediate off-site soil contamination from its operations:

    The primary remaining RI tasks include completion of the ecological risk assessment, determination of the presence and/or extent of off-site arsenic and PAH contamination in soil, revision of the human health risk assessment, and identification of “hot spots” of contamination. 

    Thus, it is highly likely, though currently unknown, what the extent of off-site contamination is in the community.

  • Nidel & Nace Obtain Preliminary Approval of Mold Class Action Settlement

    Nidel & Nace have obtained  preliminary approval of a class action settlement that will see hundreds of senior residents obtain mold inspection and remediation at their residences.

    The Willows Senior Community and the Evergreen Senior Community are a complex of apartments that lease almost exclusively to seniors, providing them apartments and various amenities such as a hair dresser and cinema room.  Joyce Herren and Louise Briggs, two residents of the complex, filed suit on behalf of all residents of the complex in Prince George’s County Maryland alleging that the community had a systemic mold problem that needed inspection and remediation.
